Bankruptcy and Creditors' Rights

By combining innovative strategies with business advisory and crisis management skills, we guide our clients through the turmoil surrounding financially troubled companies, sets priorities, and allocates resources to maximize the prospects for recovery.

Scarinci Hollenbeck delivers comprehensive services to financially troubled entities, financial institutions and other organizations involved in the restructuring and recovery of problem business credits. Our attorneys are accustomed to dealing with complex and sophisticated business matters and have many years of experience handling all financial issues surrounding bankruptcy and reorganization, out of court workouts, and state and federal court litigation over creditors' and debtors' rights.

We handle difficult bankruptcy cases for both creditors and debtors. Attorneys represent individuals, partnerships and corporations, and have significant experience in dealing with the numerous problems faced by large business debtors. Our attorneys regularly counsel clients in the areas of bankruptcies, receiverships, leveraged buy-outs, preferences and fraudulent conveyances, workouts, debt restructuring, reorganizations and liquidations, mortgage foreclosures, OREO sales transactions, UCC foreclosures and acquisitions. During the pre-bankruptcy workout stage, the we assist clients in obtaining financing or restructuring debt to avoid bankruptcy or develop strategies to obtain the maximum benefits from the Chapter 11 process.

Where litigation is necessary to resolve debt and related problems, we offer responsive and effective service at all levels, including alternative dispute resolution, prejudgment remedies, trial and appellate. Knowing that a strong litigation position often leads to a settlement of the dispute, our attorneys are practiced negotiators and make every effort to negotiate a favorable and carefully documented workout of creditor-debtor disputes.

We are highly skilled in the enforcement of creditors' rights and work with various financial institutions, insurance companies, leasing and finance companies, and with other entities interested in preserving and enforcing their rights as creditors. Our attorneys routinely advise creditors regarding their rights and remedies in bankruptcy, under the Uniform Commercial Code, in foreclosures and in other types of recovery of real and personal property, secured transactions, and other areas of commercial law. We bring together attorneys with broad and diverse business experience in order to help the firm's clients achieve creative, expeditious, and cost-effective solutions. When appropriate, attorneys consult with other attorneys in the firm on matters requiring an interdisciplinary approach.
